We accept Jurisdiction of this case, Wharfside Two, Ltd. v. W.W.Gay Mechanical Contractor, Inc., 523 So.2d 193 (Fla. 1st DCA 1988), because it conflicts with this Courts decision in New Amsterdam Casualty Co. v Utility Battery Manufacturing Co., 122 Fla. 718, 166 So. 856 (1935). We have Jurisdiction pursuant to article v, section 3(b)(3), Florida Constitution, and approve the district courts decision.
